General terms and conditions

These terms and conditions apply to all weekly microgreens subscriptions offered by Dutch Microgreens. By placing an order and taking out a subscription, you agree to these terms and conditions. Please read these terms and conditions carefully before placing an order.

1. Subscriptions

1.1 Dutch Microgreens offers weekly subscriptions of fresh microgreens. By taking out a subscription, you agree to receive a weekly delivery of microgreens for the duration of the subscription.

1.2 The subscription term is determined at the time of ordering and may vary depending on the subscription chosen.

1.3 Your subscription will automatically renew at the end of each subscription period, unless you cancel your subscription in accordance with the provisions in section 3 (Termination).

1.4 Dutch Microgreens reserves the right to slightly limit the availability of certain microgreens based on seasonality and crop availability. However, we will do our best to offer you a diverse range of fresh microgreens.

2. Payment

2.1 By taking out a subscription, you agree to pay the subscription fees according to the prices quoted.

2.2 Payment is due prior to each subscription period, unless otherwise agreed.

2.3 Dutch Microgreens reserves the right to adjust subscription fees at any time. Any price changes will take effect upon at least 30 days' prior notice.

2.4 Payment can be made via the payment methods offered on our website.

3. Termination

3.1 You may cancel your subscription at any time via your account on our website or by contacting us. Cancellation must take place at least 48 hours before the next scheduled delivery to be eligible for discontinuation.

3.2 Upon cancellation, you remain responsible for the payment of any subscription fees due prior to cancellation.

3.3 Dutch Microgreens reserves the right to terminate or suspend your subscription in case of violation of these terms and conditions or inappropriate use of our services.

4. Delivery

4.1 Dutch Microgreens will deliver the microgreens to the address you provide. It is your responsibility to ensure that the correct and complete delivery address is provided when placing your order. Dutch Microgreens is not responsible for any delays or delivery problems due to incorrect address details.

4.2 The delivery of the microgreens shall take place on the set delivery day(s) agreed at the time of entering into the subscription. Dutch Microgreens will endeavour to provide delivery on time, but cannot guarantee specific delivery times.

4.3 If you are not present at the time of delivery, Dutch Microgreens will leave the microgreens in a safe place at the specified delivery address. Dutch Microgreens is not responsible for any damage, spoilage or loss of the microgreens after delivery.

4.4 Dutch Microgreens uses eco-friendly packaging materials to ensure the freshness and quality of microgreens during transportation. We strive to use sustainable and recyclable packaging solutions.

5. Cancellation and Refunds

5.1 Dutch Microgreens does not offer refunds for subscription fees already paid, unless otherwise agreed or in case of serious defects in the microgreens provided.

5.2 In case of serious defects in the delivered microgreens, you should contact Dutch Microgreens within 48 hours of receipt to report the problem. Dutch Microgreens may at its discretion decide on an appropriate solution, such as replacement of the microgreens or refund of part of the subscription fee.

6. Liability

6.1 Dutch Microgreens aims to provide fresh, high-quality microgreens. However, due to the nature of the product, variations in colour, taste and texture may occur. Dutch Microgreens cannot guarantee specific characteristics of the microgreens.

6.2 Dutch Microgreens shall not be liable for any indirect, incidental, special or consequential damages arising from the use of the microgreens provided.

6.3 Dutch Microgreens is not liable for any allergic reactions or health problems that may arise from consuming the microgreens. It is your responsibility to report any allergies or dietary restrictions when placing your order.

7. Intellectual Property

7.1 All intellectual property rights relating to the content, logo and brand name of Dutch Microgreens remain the property of Dutch Microgreens. They may not be copied, reproduced or used for commercial purposes without prior written consent.

7.2 Dutch Microgreens may use photos, reviews or feedback you provide about our microgreens for promotional purposes on our website, social media or other marketing channels. By providing such content, you grant Dutch Microgreens a non-exclusive, royalty-free licence to use, reproduce and distribute it.

8. Privacy

8.1 Dutch Microgreens respects your privacy and acts in accordance with applicable privacy laws. Our Privacy Statement describes how we collect, use, store and secure your personal data. By placing an order, you agree to our Privacy Statement.

9. Applicable law and dispute resolution

9.1 These general terms and conditions shall be governed by and construed in accordance with the laws of the Netherlands.

9.2 Any disputes arising out of or in connection with these general terms and conditions shall be submitted to the competent courts in the Netherlands.
